IMPORTANT: PLEASE READ CAREFULLY. THIS WAIVER LIMITS NORTH FORGE’S LIABILITY AND INCLUDES A RELEASE OF CLAIMS.
In consideration for being permitted to attend a guided tour of the North Forge Fabrication Lab premises located at:
125 Adelaide Street, Winnipeg, MB R3A 0W4 and/or
312B William Avenue, Winnipeg, MB R3A 1P9 (hereinafter, the “FabLab Premises”), the undersigned Visitor acknowledges and agrees to the following:
Acknowledgement of Risk
The Visitor understands that the FabLab Premises is an operational fabrication facility that houses various types of manufacturing and prototyping equipment. Although the Visitor will not be permitted to operate or interact with any equipment, and the tour will be supervised by authorized North Forge personnel, there are inherent risks present in being near active or idle industrial equipment and tools. These risks include, but are not limited to, slips, trips, falls, or inadvertent exposure to equipment noise or movement.
Assumption of Risk
The Visitor voluntarily assumes all such risks associated with being present in the FabLab Premises, including any injury, illness, property damage, or other harm that may occur during or as a result of the visit, whether caused by the negligence of North Forge or otherwise.
Release of Liability
The Visitor hereby waives, releases, and discharges North Forge, its directors, officers, employees, volunteers, agents, and affiliates (collectively, the “Releasees”) from any and all claims, liabilities, damages, or expenses of any kind arising from or connected to the Visitor’s attendance at the FabLab Premises.
Indemnification
The Visitor agrees to indemnify and hold harmless North Forge and the Releasees from any third-party claims resulting from the Visitor’s conduct while on the FabLab Premises.
No Warranties
North Forge provides access to the FabLab Premises “as is” and makes no warranties, express or implied, regarding safety or fitness for a particular purpose.
